Successful breach of Human Rights claim for Mother in family case

Successful breach of Human Rights claim for Mother in family case – successful claim for damages by the Family Law Team.  The Mother of two children placed in section 20 foster care for 2 years successfully obtains a declaration in the Court that her and the children’s  human rights were breached by West Sussex County Council.  Both Mother and the children obtained significant financial compensation along with a costs order. The Family Law Team says ‘I am delighted we were able to obtain a declaration that the Local Authority acted inappropriately in seeking to exercise parental responsibility for these children without consent or legal authority.  I hope this ensures the rights of children and parents are respected in the future’.  If you have any issues with Social Services contact our experience family team.
